A statutory instrument is ‘made’ when signed by the minister (or person with authority under the Act); in other words the instrument is not in draft.

There are 3 clocks.

  1. Made affirmative approval period

    From Instrument made (signed into law) to Approval period ends as part of the Made affirmative procedure.

  2. Remedial order made affirmative approval period

    120 days from Instrument made (signed into law) to Approval period ends as part of the Made affirmative remedial order procedure.

  3. Remedial order made affirmative representation period

    60 days from Instrument made (signed into law) to Representations period ends as part of the Made affirmative remedial order procedure.
